ANIKA — Terms & Conditions

1. Introduction

Welcome to ANIKA, a mobile application operated by CHARACTER REFERENCE BUREAU ("CRB"). These Terms and Conditions govern your access to and use of the ANIKA application and the services offered. By accessing or using ANIKA you agree to be bound by these Terms.

2. Purpose of the App

ANIKA is a community-driven platform designed to enable users to post and search real-life experiences about people they interact with. Key capabilities include:

  1. Post experiences (positive or negative).
  2. Access stored posts and reports from other users.
  3. Merge or consolidate reports from different reporters.
  4. Upload supporting evidence where applicable (highly recommended).
  5. Share information about individuals' character where permitted.

Note: The App saves and displays reports. Use of the platform is subject to the terms below.

3. Eligibility

Use of ANIKA is limited to individuals aged 18 years and above. Minors are prohibited from using the App.

4. Accessing ANIKA

To use the App, users must:

  1. Download ANIKA from the Google Play Store (Android) or the App Store (iOS).
  2. Register with a valid phone number.
  3. Verify identity using an OTP sent to the registered phone number.
  4. Opt to remain anonymous or disclose identity at registration.
  5. By registering for and using the ANIKA App, users acknowledge that they have read, understood, and agreed to these Terms and Conditions. Users further consent to receive promotional, marketing, informational, and service-related messages from the ANIKA platform through SMS, email, push notifications, or other communication channels.

Developers do not guarantee the accuracy or completeness of posted information. Users access and rely on content at their own risk. All posts are permanent and may only be updated by the aggrieved party following reconciliation.

5. Notification to Reported Individuals

When a report is published, ANIKA will make reasonable efforts to notify the individual who is the subject of the report (the "Reported Party"). Notifications include general details about the report and, where permitted, the reporter’s identity.

6. Access to Reporting User’s Information

If a reporting user chooses to remain anonymous, ANIKA will disclose their identity only upon receipt of a valid court order compelling disclosure. ANIKA will notify the anonymous user and request that they comply with the court order.

Verification of a court order must be completed within 14 days. A processing fee will be communicated to the aggrieved party to facilitate compliance; the fee is payable upon service of the court order to ANIKA managers.

7. User Responsibilities

  1. Users must act responsibly and ethically when posting.
  2. ANIKA managers are not responsible for user-posted content. Users bear full responsibility for anything they post.
  3. False reports, rumours, or defamatory statements are prohibited and discouraged.
  4. When possible, users should provide supporting evidence for claims.
  5. Users must not impersonate or misrepresent others.

8. Data Collected and Use

We may collect the following information:

  • Name
  • Phone number
  • Passport or National ID number
  • Location
  • Photo
  • Email

Data is used to: facilitate accurate search results, support the reliability of user submissions, and enable user verification and accountability. ANIKA managers will use collected data only for the purposes described and will not use it for unrelated activities.

9. Third-Party Access

Third-party access to data will be granted only for legal compliance purposes. Only a valid court order can compel ANIKA managers to disclose the identity of an anonymous user.

10. Monetisation & Fees

The following service fees apply:

  • Posting a report: KES 50
  • Searching and revealing posted information: KES 100

Other fees (e.g., mediation, legal verification) may apply as determined by ANIKA managers.

11. Security Measures

ANIKA implements security measures including end-to-end encryption and strict access controls to protect user data. While we take reasonable steps to secure data, no system is completely secure and ANIKA cannot guarantee absolute security.

12. Consent & Tracking

By using the App, users consent to the collection and processing of personal information as described. Tracking technologies (such as cookies) may be used to improve service delivery.

13. Dispute Resolution

Users are encouraged to resolve disputes directly. If unresolved, parties may seek legal redress. ANIKA managers may offer mediation services at a fee to be negotiated based on case complexity.

14. Amendments

ANIKA managers reserve the right to amend these Terms and Conditions at any time without prior notice. Continued use of the App constitutes acceptance of the updated Terms. Users should review these Terms periodically.

16. Consent to Share Personal Information

By using the App, users explicitly consent to the sharing of personal information (including name, contact details, and submitted content) for the purposes of verification, legal requests, and maintaining platform integrity. Users acknowledge that information may be disclosed to legal authorities or reported parties if required by law or court order.
